1. Acceptance of Terms

By accessing or using Beeving's services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use our services.

These terms apply to all users of the Beeving platform, including visitors, registered users, and paying subscribers.

2. Description of Service

Beeving provides a B2B email marketing platform that enables businesses to:

• Create and send email campaigns and sequences
• Manage contact lists and segments
• Track email performance and analytics
• Automate email workflows based on triggers and conditions
• Integrate with third-party tools and CRMs

3. Account Registration

To use our services, you must:

• Be at least 18 years old
• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

4. Acceptable Use Policy

You agree NOT to use Beeving to:

• Send unsolicited bulk emails (spam) to purchased or scraped lists
• Send emails to recipients who have not consented to receive them
• Include false or misleading header information
• Send content that is illegal, harmful, or violates third-party rights
• Distribute malware, phishing attempts, or fraudulent content
• Violate CAN-SPAM, GDPR, or other applicable email regulations
• Impersonate another person or entity
• Interfere with or disrupt our services or servers

Violation of this policy may result in immediate account suspension or termination.

5. Email Compliance

You are responsible for ensuring your email campaigns comply with:

• GDPR: Obtaining valid consent, honoring data subject rights
• CAN-SPAM: Including physical address, honor unsubscribe requests
• CASL: Canadian Anti-Spam Legislation requirements
• Any other applicable local, national, or international laws

All emails sent through Beeving must include a working unsubscribe link.

6. Subscription and Payment

Subscription terms:

• Subscriptions are billed monthly or annually in advance
• Prices are exclusive of applicable taxes
• We may change prices with 30 days' notice
• You may cancel your subscription at any time
• Refunds are provided according to our refund policy

7. Free Trial

We offer a 14-day free trial for new users. No credit card is required. At the end of the trial period, you must subscribe to a paid plan to continue using the service. We reserve the right to limit or modify the trial offer at any time.

8. Intellectual Property

Beeving and its licensors retain all rights to the platform, including software, designs, logos, and documentation. You retain ownership of your content (emails, contact lists, etc.).

By using our service, you grant us a limited license to process your content as necessary to provide the service.

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We may temporarily suspend service for:

• Scheduled maintenance (with advance notice when possible)
• Emergency maintenance or security updates
• Circumstances beyond our reasonable control

10. Limitation of Liability

To the maximum extent permitted by law:

• Our total liability is limited to the amount you paid in the 12 months preceding the claim
• We are not liable for indirect, incidental, or consequential damages
• We are not liable for lost profits, data, or business opportunities

11. Indemnification

You agree to indemnify and hold Beeving harmless from any claims, damages, or expenses arising from your use of the service, violation of these terms, or infringement of any third-party rights.

12. Termination

Either party may terminate the agreement:

• You may cancel your account at any time through your account settings
• We may suspend or terminate accounts for violation of these terms
• Upon termination, your right to use the service ends immediately
• You may export your data within 30 days of termination

13. Changes to Terms

We may modify these terms at any time. We will notify you of material changes by email or through the platform. Continued use of the service after changes constitutes acceptance of the new terms.

14. Governing Law

These terms are governed by the laws of France. Any disputes shall be resolved in the courts of Paris, France.
